I Want to File Bankruptcy without an Attorney – Pro Se

A Pro Se Debtor is someone who represents himself in a legal procedure without an attorney. It is an established tenet that you have the right to represent yourself in a court of law, however, many people do not understand that choosing to represent yourself means that the Court will expect you to follow the same rules and procedures that an attorney must follow.

Court staff may assist you with procedures only and very often there is a fine line between procedural information and legal advice. Staff cannot give legal advice. Procedural information includes such matters as where to obtain forms for some procedures, how to file a petition, answer requirements, service requirements on common procedures, how to get a default, how to file a motion, how to get a hearing, etc.

A Pro Se Debtor is responsible for all of the legal proceedings in his/her case. Failure to comply with the Bankruptcy Code, Rules of Procedure, or with court orders may cause dismissal of the Debtor’s case. It is highly recommended that all debtors seek the advice of an attorney before attempting to file their own case.
